Case Study #1 : Contentious Probate

We were engaged to assist the Partner of a firm of solicitors instructed to administer an estate, to ascertain sums fraudulently taken from the estate by two of his staff during the course of the administration and laying the foundation for the ensuing Court case. 

Outcome :
The members of staff involved had destroyed most of the incriminating evidence, but following our intervention were both convicted of fraud.
Case Study #3 : Contentious Probate

We were instructed by four of the siblings of the deceased who died with an estimated estate of £300k. Our client's believed that their brother died Intestate, but one further sister some weeks after death, produced a Will appointing her as sole executor and beneficiary.  The Will was a one line typewritten store-bought document, ie best described as 'homemade'.  The deceased's signature looked reasonably authentic, until it was compared to an original, when it could be seen to be a forgery.  The witnesses were friends and neighbours of the appointed Executor and her daughter, one of whom had a conviction for fraud.  After placing the necessary Caveats, I instructed a handwriting expert to carry out the appropriate forensic analysis, and she found the signature to be a forgery. 

Outcome :
Our intervention resulted in the case being settled out of Court and the estate administered in accordance with the Rules of Intestacy.  The clients decided not to pursue their sister for the attempted fraud.
Case Study #4 : High Net Worth Trust

We were engaged to assist a firm of solicitors in preparing Estate Accounts for a high net worth trust.  Also to respond to a claim by solicitors instructed by the sons of the deceased for maladministration. 

Outcome :
The claim was for £280k.  Following our intervention the claim was settled at £30k.


Case Study #2 : Fraud

We have assisted the Executors of various estates in quantifying the values of each estate following the Law Society's intervention into the firm instructed to administer the estates on the Executor's behalf.  The owner of the firm in question had absconded to India with all of the client's monies.

Outcome :
Once the value of the estate had been quantified, a claim was successfully submitted to the Law Society Compensation Fund, including lost interest.
